ChurchLibrary, a ministry of Church of the Highlands, Inc., respects the intellectual-property rights of others. This Copyright and DMCA Policy explains how we address copyright complaints relating to content stored or processed through the Service.
ChurchLibrary allows Customers to submit or direct us to process content. We do not pre-screen content for ownership or rights clearance and do not adjudicate private ownership disputes. Customers are responsible for having sufficient rights and permissions for content they submit.
1. Copyright Complaints
If you believe in good faith that material available through or stored by ChurchLibrary infringes a copyright you own or are authorized to enforce, you may send a written notice to our designated copyright agent containing substantially the following:
1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by one notice, a representative list of those works.
3. Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient to allow us to locate the material.
4. Your name and contact information, including address, telephone number, and email address if available.
5. A statement that you have a good-faith belief that the use complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Designated Copyright Agent
Notices should be sent to:
Church of the Highlands, Inc. — Attn: ChurchLibrary Copyright Agent 3660 Grandview Pkwy, Birmingham, AL 35243 Phone: 205-980-5577 Email: chase@vessel.org
The contact information above should match the designated-agent information registered for the applicable legal entity with the U.S. Copyright Office. If operation of ChurchLibrary is transferred to a separate legal entity, the applicable entity should maintain its own designation as required for any safe-harbor protection it seeks.
3. What We May Do After Receiving a Notice
We may review a complaint for substantial compliance, request additional information, remove or disable access to the identified material, notify the affected Customer or user, and take other action we consider appropriate under applicable law, our Terms of Service, and this policy.
Removal or disabling of content does not constitute an admission that infringement occurred, and ChurchLibrary does not determine ownership of disputed works.
4. Counter-Notification
If you believe material was removed or disabled because of mistake or misidentification, you may send our designated agent a written counter-notification containing substantially the following:
1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number.
5. A statement that you consent to the jurisdiction of the appropriate federal district court as required by 17 U.S.C. § 512(g), and that you will accept service of process from the person who submitted the original notice or that person's agent.
Where the statutory counter-notice process applies, we may restore the material not less than 10 and not more than 14 business days after receiving a valid counter-notification unless our designated agent first receives notice that the complaining party has filed an action seeking a court order relating to the disputed material.
5. Repeat Infringers
In appropriate circumstances, we may suspend or terminate Customers or Authorized Users who are repeat infringers or who repeatedly submit content without sufficient rights. We may also remove or restrict content when we reasonably believe continued hosting or processing presents a legal risk.
6. Misrepresentations and Other Rights
Knowingly making material misrepresentations in a copyright notice or counter-notification may result in liability under applicable law. Copyright notices should address copyright claims only. Complaints involving trademark, privacy, publicity, confidentiality, or other rights may be submitted to the contact address below and will be evaluated under our Terms of Service and applicable law.
